Terms & Conditions

By downloading or using any application (“app”) published by Fishball Ltd (“we,” “our,” or “us”), you (“user” or “you”) agree to comply with and be bound by the following terms and conditions. Please read them carefully before using our apps.

1. Definitions

App: Any mobile application developed and published by Fishball Ltd.
User: Any individual who downloads, installs, or uses our app.

2. Intellectual Property Rights

All intellectual property rights concerning our apps, including but not limited to copyrights, trademarks, and database rights, remain the property of Fishball Ltd. You are prohibited from:

Copying, modifying, or creating derivative works of any part of the app.
Attempting to extract the source code of the app.
Translating the app into other languages.
Using our trademarks in any manner not expressly permitted by us.

3. Licence Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the app solely for your personal, non-commercial use.

4. App Usage and Charges

We strive to ensure our apps are as useful and efficient as possible. We reserve the right to make changes to the app or to charge for its services at any time for any reason. Any charges will be clearly communicated to you in advance.

5. Privacy Policy

Our Privacy Policy, which is incorporated into these Terms by reference, outlines how we handle your personal data and protect your privacy when you use our apps.

6. Subscriptions

Some of our apps offer auto-renewable subscriptions that provide access to premium features or content. Specific details of each subscription, including title, length, and price, are presented within the respective app at the time of purchase.

General Terms Applicable to All Subscriptions:

Payment: Subscription payments will be charged to your account upon confirmation of purchase and will automatically renew unless cancelled at least 24 hours before the end of the current period.
Cancellation: You can manage and cancel your subscriptions by accessing your account settings on the respective platform (e.g., App Store, Google Play) after purchase.
Free Trials: If a free trial is offered, any unused portion will be forfeited upon purchasing a subscription.
Right to Cancel: If you reside in the UK or EU, you may have the right to cancel your subscription within 14 days of purchase. However, by agreeing to immediate access to premium features or content, you waive this right under consumer protection laws.

7. Account Deletion

If the app supports account creation, it also provides an option to delete your account within the app. To delete your account:

Navigate to the account settings section within the app.
Select the “Delete Account” option.
Follow the on-screen instructions to confirm your decision.

Please note that deleting your account is irreversible. Upon deletion, all associated data that we are not legally required to retain will be permanently removed.

9. Apple App Store

The following additional terms apply when you download an app from the Apple App Store. They are required by Apple and, in the event of any conflict with the rest of these Terms, apply to your use of that app on Apple devices:

Parties. These Terms are concluded between you and Fishball Ltd only, and not with Apple. Apple is not responsible for the app or its content.
Scope of licence. The licence granted to you for the app is a non-transferable licence to use the app on any Apple-branded device that you own or control, as permitted by the Usage Rules set out in Apple’s Media Services Terms and Conditions.
Maintenance and support. Fishball Ltd is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services.
Warranty. Fishball Ltd is solely responsible for any product warranties, whether express or implied. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) of the app; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the app.
Claims. Fishball Ltd, not Apple, is responsible for addressing any claims relating to the app or your use of it, including (i) product liability claims, (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
Intellectual property. In the event of any third-party claim that the app or your possession and use of it infringes that party’s intellectual property rights, Fishball Ltd, not Apple, is responsible for the investigation, defence, settlement, and discharge of any such claim.
Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

10. Limitation of Liability

To the fullest extent permitted by law, Fishball Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the app;
Any conduct or content of any third party on the app;
Unauthorised access, use, or alteration of your transmissions or content.

Nothing in these Terms shall exclude or limit our liability for death or personal injury resulting from our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

11. Governing Law & Jurisdiction

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Termination of Service and Access

We may update, suspend, or discontinue the app at any time. If discontinued, we will make reasonable efforts to notify you in advance. You must stop using the app and delete it from your device upon termination.

We may also suspend or terminate your access to the app without notice if you violate these Terms.

13. Eligibility

Our apps are not intended for children under the age of 13. If you are under 13, you may not use our apps unless your parent or legal guardian has reviewed and agreed to these Terms.

14. Changes to These Terms and Conditions

We may update our Terms and Conditions from time to time. You are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
